Privacy Policy

1.1 Data Controller. ModernMarketingWorks, located at 08014, Crer. Leiva, 25, Barcelona, Barcelona, Spain, is the data controller responsible for the processing of personal data collected through this website. Contact: [email protected].

1.2 Data Collected. We collect personal identification information (name, email address, phone number, company name) submitted voluntarily through our contact forms. We also collect non-personal data automatically: browser type, IP address, referring URL, pages visited, and timestamps.

1.3 Purpose of Processing. Personal data is processed exclusively for: (a) responding to project inquiries and providing service proposals; (b) delivering contracted digital services; (c) sending administrative communications related to active engagements; (d) complying with applicable tax and commercial record-keeping obligations under Spanish law.

1.4 Legal Basis. Processing is based on your explicit consent (Article 6(1)(a) GDPR) when you submit a contact form, and on the performance of a contract (Article 6(1)(b) GDPR) when you engage our services.

1.5 Data Retention. Personal data is retained for as long as necessary to fulfill the purposes for which it was collected, or as required by applicable tax and commercial retention laws (typically 5 years for financial records in Spain). Data submitted via contact forms without a resulting engagement is deleted after 12 months.

1.6 Third-Party Sharing. We do not sell, rent, or trade personal information to third parties. Data may be shared with trusted service providers (hosting, email delivery, payment processing) strictly for operational purposes, subject to data processing agreements in compliance with GDPR Article 28.

1.7 Your Rights. Under the GDPR, you have the right to access, rectify, erase, restrict processing, object to processing, and port your personal data. Terms of Service

2.1 Acceptance. By accessing or using the services provided by ModernMarketingWorks (08014, Crer. Leiva, 25, Barcelona, Barcelona, Spain), you agree to be bound by these Terms of Service. If you do not agree, please refrain from using our services.

2.2 Scope of Services. ModernMarketingWorks provides digital agency services including but not limited to: web platform development, conversion funnel engineering, SEO and analytics, brand identity design, paid media management, content marketing, email automation, social media management, and cloud hosting. Specific deliverables, timelines, and pricing are defined in individual Statements of Work (SOW) or project proposals.

2.3 Payment Terms. Unless otherwise agreed in writing, invoices are due within 14 days of issuance. Late payments may incur a statutory interest rate of 4% per annum above the ECB reference rate, in accordance with Spanish commercial law. Projects may be paused if payments are more than 15 days overdue.

2.4 Intellectual Property. Upon full payment of all agreed invoices, all intellectual property rights, source code, design files, and digital assets created specifically for the client are irrevocably transferred to the client. ModernMarketingWorks retains the right to display non-confidential project work in portfolio materials unless explicitly declined in writing.

2.5 Client Responsibilities. The client is responsible for providing timely access to necessary accounts, brand assets, content, and feedback. Delays in client-provided materials may result in adjusted timelines. The client warrants that all materials provided do not infringe upon third-party intellectual property rights.

2.6 Limitation of Liability. ModernMarketingWorks shall not be liable for indirect, incidental, or consequential damages. Total liability under any engagement shall not exceed the total fees paid by the client for the specific service giving rise to the claim. We are not responsible for losses resulting from third-party platform changes, algorithm updates, or force majeure events.

2.7 Termination. Either party may terminate a project with 14 days' written notice. In the event of termination, the client is responsible for payment of all work completed up to the termination date. Work-in-progress交付ables will be delivered in their current state upon final payment.

Cookie Policy

3.1 What Are Cookies. Cookies are small text files stored on your device when you visit our website. They help us recognize your browser, remember your preferences, and improve your browsing experience.

3.2 Types of Cookies Used. This website uses only strictly necessary cookies:

  • Session cookies: Required for basic website functionality and are deleted when you close your browser.
  • Preference cookies: Store your cookie consent choice via localStorage to prevent the consent banner from reappearing on subsequent visits.

3.3 No Third-Party Tracking. ModernMarketingWorks does not use Google Analytics, Facebook Pixel, advertising cookies, or any third-party tracking technologies. We do not sell or share browsing data with advertising networks.

3.4 Managing Cookies. You can control and delete cookies through your browser settings. Disabling strictly necessary cookies may impair basic website functionality. Most browsers allow you to block or delete cookies via their settings or preferences panel.

Art. 4

Refund & Reimbursement Policy

4.1 General Policy. ModernMarketingWorks is committed to delivering high-quality digital services. Due to the bespoke nature of digital agency work, refunds are handled on a case-by-case basis as outlined below.

4.2 Pre-Project Cancellation. If a project is cancelled before any work has commenced (within 48 hours of SOW signing), a full refund of any advance payment will be issued within 10 business days.

4.3 Partial Work Cancellation. If a project is cancelled after work has begun, the client will be invoiced for all work completed up to the cancellation date. Any excess advance payment beyond completed work will be refunded within 10 business days. Work completed is billed at the hourly or milestone rate specified in the SOW.

4.4 Deliverable Revisions. Each project includes a defined number of revision rounds as specified in the SOW (typically 2–3 rounds). Additional revisions beyond the agreed scope are billed at a standard hourly rate of €85/hour. Failure to provide timely feedback (within 5 business days of deliverable submission) does not constitute grounds for a refund.

4.5 Refund Request Process. To request a refund, contact [email protected] with your project reference number, a description of the issue, and supporting evidence. All refund requests are reviewed within 5 business days.

4.6 Non-Refundable Items. Third-party costs incurred on behalf of the client (domain registrations, stock imagery, advertising spend, premium plugin licenses) are non-refundable. Monthly retainer services may be cancelled with 30 days' notice but are non-refundable for the current billing period.

4.7 Governing Law. This refund policy is governed by the laws of Spain. Any disputes arising from refunds shall be subject to the exclusive jurisdiction of the courts of Barcelona.
